• Subscriptions automatically renew unless canceled before the renewal date.

• No refunds will be provided for unused portions of a subscription.

 
3. Limitation of Liability
 

• We are not liable for app downtime, data loss, or damages resulting from app use.

 
4. Termination
 

• We reserve the right to suspend or terminate your access for violations of these terms.

5. Intellectual Property and Ownership

• All software, services, and content provided as part of the Lotus Chess application are proprietary and are the exclusive property of Lotus Chess UG (haftungsbeschränkt) or its licensors, unless explicitly stated otherwise.

• No part of the Lotus Chess application may be copied, modified, distributed, reverse-engineered, or used to create derivative works without prior written permission from Lotus Chess UG, except as permitted by applicable law.

6. Governing Law
 

• These terms are governed by the laws of Germany.

We respect your privacy. This Privacy Policy explains how we collect, use, disclose, and protect your information when you use our app, Lotus Chess, available on iOS and Android platforms. Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not use the app.
 
7. Information We Collect
 
Information You Provide to Us

• Account Information: When you create an account, we may collect your name, email address, and other necessary details.

• Gameplay Data: Information about your interactions with the app, such as your chess openings, performance statistics, or training progress.

• Sync Data: If you use a Lotus Account, we may store your training progress, app settings, and other app-related data to provide persistent storage and cross-device synchronization.

 
Information Collected Automatically

• Device Information: We may collect information about the device you use, such as the device type, operating system, and app version.

• Usage Data: Details about how you interact with the app, including crash reports, features accessed, and time spent.

• Location Data (if applicable): Approximate location data based on your device’s IP address.

• Advertising and Attribution Data: The app shows no ads, but we run ad campaigns on other platforms. To measure which campaigns lead to installs, we use AppsFlyer. It receives device identifiers, usage events (such as app opened and chess account linked) and device data; trials, purchases, renewals and cancellations are reported to AppsFlyer by RevenueCat. On iOS the app asks for your permission to track (App Tracking Transparency). We collect the advertising identifier (IDFA) only if you allow it; otherwise we use the identifier for vendor (IDFV), which is shared only across our own apps. On Android we collect the Google Advertising ID, which you can reset or delete in your device settings. AppsFlyer passes campaign results on to the ad networks we use (currently Google Ads and TikTok; Meta only while we run campaigns there). On iOS, Apple's SKAdNetwork also reports campaign results in aggregated form.

 
Information from Third-Party Services
If you connect your Lichess or other chess platform accounts, we may collect relevant information, such as game statistics and performance data. We never share your Lichess or Chess.com username with analytics or advertising partners; they only learn which site you linked.
 
8. How We Use Your Information

• Provide, maintain, and improve the app’s functionality.

• Create and manage Lotus Accounts.

• Save your progress and synchronize it across devices.

• Analyze performance data to tailor personalized training plans.

• Measure advertising performance and improve marketing campaigns.

• Communicate with you regarding updates, support, and offers.

• Ensure compliance with legal obligations and protect against unauthorized use.

 
9. How We Share Your Information
 
We do not sell your information. However, we may share your data in the following circumstances:

• Service Providers: With vendors who help run the app: AppsFlyer (ad attribution), Google Firebase (analytics, crash reports, push notifications), RevenueCat (subscriptions) and Apple and Google (app stores and payments). AppsFlyer, Firebase and RevenueCat process data in the United States; we rely on the EU–U.S. Data Privacy Framework or the EU Standard Contractual Clauses.

• Legal Requirements: If required to comply with a legal obligation or to protect our rights.

• Aggregated Data: Non-identifiable, aggregated usage data for research or marketing purposes.

 
10. Data Security
 
We implement reasonable technical and organizational measures to protect your personal information. However, no security system is impenetrable, and we cannot guarantee the security of your data.
 
11. Your Choices
 

• Account Settings: You can update your account information or delete your account within the app.

• Permissions: You can control device permissions such as location or notifications through your device settings.

• Data Deletion: To delete your account and data, follow the steps on www.lotus-chess.com/delete-account, or email feedback@lotus-chess.com.

• Ad Measurement: You can object to ad measurement at any time by writing to apps@lotus-chess.com. On iOS you can allow or withdraw tracking permission at any time in Settings → Privacy & Security → Tracking. On Android you can also reset or delete your advertising ID in your device settings.

The app may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties.
